Bankers' Books Evidence Act, 2026 comes into force on 1 October 2026
The Bankers' Books Evidence Act, 2026, which received Presidential assent on 13 August 2026 and replaces the 1891 Act of the same name, will commence on 1 October 2026. The new Act is technology-neutral: a banker's book now includes records kept in physical, electronic, digital, virtual and cloud-based form, and certification may be by manual, digital or electronic signature. Courts must record a special cause in writing before summoning a bank official where the bank is not a party, and the Central Government may extend the framework to specified financial-sector entities.

SFT-2517 notified: depositories to report capital gains on listed securities
The Directorate of Income Tax (Systems) has notified the format, procedure and guidelines for SFT-2517 under s.508(1) of the Income-tax Act, 2025 read with rule 237(6) of the Income-tax Rules, 2026. The statement carries capital gains on transfer of listed securities so the figures can pre-fill the return. Every depository under s.2(1)(e) of the Depositories Act, 1996 must file it, half-yearly: the half ending 30 September is due by 31 October and the half ending 31 March by 30 April. Depositories must also give the same data to the account holder for reconciliation against Form 168.

SFT-2518 notified: RTAs to report capital gains on mutual fund units
The companion notification covers SFT-2518, capturing capital gains on transfer of units of mutual funds, to be filed by the Registrar and Share Transfer Agent registered with SEBI. Same statutory basis and the same half-yearly calendar as SFT-2517, so the first statement under the 2025 Act is due by 31 October 2026. The RTA must also pass the information to the investor for Form 168 reconciliation. Expect mutual fund gains to arrive pre-filled; switches and SWP redemptions are where reported cost most often goes wrong.

GST · GSTN advisory, 7 Sep 2026
Appeals now allowed against demand orders showing NIL or zero demand
GSTN has removed the portal validation that blocked an appeal where the demand order showed NIL or Zero. Where liability is disputed but the taxpayer had already paid before the order issued, an appeal in Form GST APL-01 can now be filed against that order. This closes a gap first flagged on the portal in April 2026 and is worth revisiting for any appeal abandoned on this ground, subject to limitation.

Draft KYC amendment on debit freezes in money-mule accounts, out for comment
Acting on a Supreme Court order dated 4 August 2026, the RBI has issued draft Reserve Bank of India (Know Your Customer) Amendment Directions, 2026 for public comment. They amend the "Operations of Bank Accounts and Money Mules" instructions in the KYC Directions, 2025 and prescribe the SOP a bank must follow before placing a temporary debit hold on an account or amount linked to money-mule activity or cyber-enabled fraud. The consolidated draft covers all commercial banks (including SFBs, payments banks, RRBs and local area banks) and urban cooperative banks; final directions will issue separately for each class. Comments are due by 2 October 2026 via Connect 2 Regulate or e-mail.

Fifteen offshore crypto platforms served notices, apps and URLs to be taken down
FIU-IND has issued non-compliance notices under s.13 of the PMLA, 2002 to fifteen offshore Virtual Digital Asset Service Providers: Weex, Blofin, Rezorex, Bitunix, DigiFinex, Toobit, XT.com, Latoken, WOO X, Pionex, ChangeNow, SimpleSwap, Fixedfloat, WhiteBIT and Guardarian. As nodal officer under s.79(3)(b) of the IT Act, 2000 read with rule 3(1)(d) of the IT (Intermediary Guidelines) Amendment Rules, 2025, the Director has also ordered their applications and URLs taken down. VDA service providers, onshore or offshore, have had to register with FIU-IND as reporting entities since March 2023.

FEMA · A.P. (DIR Series) Circular No. 21, 8 Sep 2026
Seven spent FEMA circulars withdrawn in the rationalisation review
As part of the RBI's review of every FEMA circular issued since 1 June 2000, seven A.P. (DIR Series) circulars that had ceased to be operative through later amendment, redundancy, overlap or supersession are withdrawn. Five concern ECB policy, one the MTSS sub-agent list and one investment in tax-free secured redeemable non-convertible bonds. Nothing is revived and no new obligation arises; the value is housekeeping, so any standing FEMA or ECB opinion citing them should be re-pointed.

RBI · PSL Third Amendment Directions, 11 Sep 2026
FCNR(B) and NRE deposit concession pulled back by a month
The RBI (Priority Sector Lending - Targets and Classification) Third Amendment Directions, 2026 [RBI/2026-27/256] change one date. The Second Amendment of 7 August 2026 had let banks exclude advances made against fresh FCNR(B) deposits of three to five years, and NRE term deposits of three years or more, from Adjusted Net Bank Credit where those deposits were mobilised up to 30 September 2026. That end date is now brought back to 31 August 2026, so the concession has already closed.

New handbook maps the old residence provisions onto the 2025 Act
The International Taxation Committee has issued the Handbook on Residential Status for NRIs - Tax and FEMA Aspects, a July 2026 edition running to 165 pages, now on the ICAI Publication Portal. The useful part is Chapter 2, which works through s.6(1) to s.6(8), s.6(13) and s.6(14) of the Income-tax Act, 2025 as questions and answers and gives an old-to-new mapping table for every limb, so the 182-day and 60-day / 365-day tests, the employment-departure and visiting-PIO carve-outs, the Rs 15 lakh threshold, the foreign-bound-ship day count, deemed residency and the not-ordinarily-resident conditions can each be traced from the 1961 provision to its 2025 successor. Chapter 10 sets out the four combinations that arise when income-tax residence and FEMA residence diverge. A companion Handbook on Safe Harbour Rules (82 pages) sits alongside it.

Taxpayer data to be shared with Andhra Pradesh for welfare targeting
Notification No. 118/2026 [S.O. 5003(E)] specifies the Secretary, ITE and C, Government of Andhra Pradesh under s.258(1)(b) of the Income-tax Act, 2025, and a companion Order under s.258(1) of the same date directs the DGIT (Systems) to furnish the information. The state supplies Aadhaar or PAN and a tax year; the Department answers Yes, No or Not Available against an agreed income threshold rather than disclosing income figures, and reports non-availability where Aadhaar is not linked to PAN. Exchange terms and data deletion are to be fixed by a memorandum of understanding.

Lower and nil deduction certificates for TY 2026-27 mapped to the new Act
TRACES is issuing LDC and NDC for Tax Year 2026-27 under the Income-tax Act, 2025, on Form 13 applications filed up to 31 March 2026. Where an old section maps to several new ones (the portal cites 194A and 194J(b)), the certificate has been mapped to every relevant new-Act section. Check the section on each client's certificate against the actual nature of payment before applying the lower rate, rather than assuming a clean one-to-one carry-over.

MCA · Quiet window
Nothing new from MCA; CBIC issued nothing this week
No MCA circular, notification or public notice issued in the 7 - 12 September window; the latest remains General Circular No. 4/2026 of 31 August 2026 extending CCFS-2026 to 15 September. CBIC issued no GST notification, circular, instruction or order in the window, so the only GST movement was the portal advisory at item 04. Also noted, no action: RBI's Local Area Banks CRR and SLR Second Amendment Directions (11 September) and two updates to the UNSC sanctions lists under s.51A of the UAPA, 1967 (7 September). SEBI's 9 and 10 September circulars on commodity-derivatives position limits, and its consultation papers on MII governance and the consolidated account statement, are capital-markets items with no audit or practice angle. On watch: the CCFS-2026 window shuts on 15 September. The 57th GST Council meeting, listed for 12 September, is widely reported to have been put back to 7 October 2026, with the officers' meeting on 5 and 6 October; the GST Council Secretariat has not published that memorandum on its website, so treat the new date as indicative until it appears officially.
Item 01 · Bankers' Books Evidence Act, 2026 · Banking law · new law · Material
01.1
Reference
Bankers' Books Evidence Act, 2026, assented to on 13 August 2026; commencement notification dated 10 September 2026 appointing 1 October 2026 as the date of coming into force, announced by PIB on 11 September 2026.
01.2
Scope
Replaces the Bankers' Books Evidence Act, 1891 in full. A banker's book is redefined technology-neutrally to include records kept in physical, electronic, digital, virtual and cloud-based form.
01.3
What changed
Certification - simplified and standardised, and may be by manual, digital or electronic signature
Summoning officials - where the bank is not a party, the Court must record a special cause in writing before summoning a bank officer
Extension power - the Central Government may extend the Act to specified financial-sector entities or classes of entities
01.4
Why it matters
A bank statement is only evidence if it is certified in the form the statute requires. From 1 October the required form changes, and so does the class of record that qualifies. This reaches recovery suits, s.138 cheque cases, insolvency filings and tax litigation alike.
01.5
Action
Move to the new certificate format for any bank record going into evidence on or after 1 October 2026, and re-check certificates already obtained for matters still pending. Auditors relying on bank-maintained records should note the wider definition.
Item 02 · SFT-2517, depository transactions · Direct Tax · new law · Material
02.1
Reference
Directorate of Income Tax (Systems) Notification No. 1 of 2026 dated 10 September 2026, F.No. DGIT(S)/ADG(S)-2/Reporting Portal/2026.
02.2
Basis
s.508(1) of the Income-tax Act, 2025 read with rule 237(6) of the Income-tax Rules, 2026. Rule 237(6) requires an SFT carrying capital gains on transfer of listed securities, for the purpose of pre-filling the return of income.
02.3
Who files
Every depository as defined in s.2(1)(e) of the Depositories Act, 1996. Data files are submitted over the SFTP server on credentials communicated separately, with a separate control statement signed and verified by the Designated Director.
02.4
Frequency
Half-yearly.
Half ending 30 September - due on or before 31 October
Half ending 31 March - due on or before 30 April
The first statement under the 2025 Act therefore falls due 31 October 2026.
02.5
Taxpayer copy
The reporting entity must also provide the information reported to the Department to the account holder, so the taxpayer can reconcile it against the Annual Information Statement in Form 168. Inaccuracies are corrected by filing a correction or deletion statement.
02.6
Action
Tell depository and broking clients the first SFT-2517 is due 31 October 2026 and that the Designated Director control statement is a separate filing. For every other client, expect listed-securities capital gains to arrive pre-filled in Form 168 and reconcile before filing.
Item 03 · SFT-2518, mutual fund transactions · Direct Tax · new law · Material
03.1
Reference
Directorate of Income Tax (Systems) Notification No. 2 of 2026 dated 10 September 2026.
03.2
Basis
s.508(1) of the Income-tax Act, 2025 read with rule 237(6) of the Income-tax Rules, 2026, covering capital gains on transfer of units of mutual funds.
03.3
Who files
The Registrar and Share Transfer Agent registered with SEBI. Same SFTP submission route and the same Designated Director control statement as SFT-2517.
03.4
Frequency
Half-yearly, on the identical calendar: 31 October for the half ending 30 September and 30 April for the half ending 31 March.
03.5
Action
Mutual fund capital gains will be pre-filled in Form 168 from this cycle. Reconcile the AIS figure against the client's own capital-gains statement before filing, with particular care on switches and SWP redemptions, where reported cost of acquisition is most often wrong.
Item 04 · Appeals against NIL demand orders · GST · portal change
04.1
Reference
GSTN advisory dated 7 September 2026, "Enabling Filing of Appeals in Cases Involving NIL or Zero Demand Amount".
04.2
What changed
The portal validation that prevented an appeal against a demand order reflecting a NIL or Zero demand has been removed. An appeal in Form GST APL-01 can now be filed against such an order.
04.3
Which applies
The situation addressed is one where liability is genuinely disputed but the taxpayer had already paid before the demand order issued, so the order records no outstanding demand. GSTN first acknowledged the difficulty in an advisory of 3 April 2026; this advisory records the fix.
04.4
Action
Revisit any appeal that was abandoned or never filed because the portal refused it. Check the limitation period under s.107 first, since the block was technical and does not by itself extend time. Raise a helpdesk ticket if the portal still refuses.
Item 05 · Draft KYC Amendment Directions, 2026 · RBI · draft for comment · Comments close 2 Oct
05.1
Reference
RBI press release dated 11 September 2026 issuing the draft Reserve Bank of India (Know Your Customer) Amendment Directions, 2026 for public comment.
05.2
Origin
Directed by the Supreme Court order dated 4 August 2026, which required the RBI to adopt and circulate a Standard Operating Procedure prescribing what banks must do when placing a temporary debit hold on amounts or accounts linked to money-mule activity and cyber-enabled financial fraud.
05.3
Scope
Amends the Operations of Bank Accounts and Money Mules instructions in the KYC Directions, 2025. The consolidated draft covers all commercial banks, including small finance banks, payments banks, regional rural banks and local area banks, and urban cooperative banks. Final directions will issue separately for each class of regulated entity.
05.4
Action
Comments are due by 2 October 2026, through the Connect 2 Regulate section of the RBI website or by e-mail titled "Feedback on Draft Reserve Bank of India (Know Your Customer) Amendment Directions, 2026". Clients whose current accounts have been frozen on money-mule suspicion, and banking audit clients, should read the draft SOP now: it will govern how a debit freeze is imposed and how long it may run.
Item 06 · FIU-IND notices to VDA service providers · PMLA · enforcement
06.1
Reference
PIB release dated 9 September 2026, Ministry of Finance, on notices issued by the Director, FIU-IND.
06.2
Basis
s.13 of the Prevention of Money-Laundering Act, 2002 for the non-compliance notices; s.79(3)(b) of the Information Technology Act, 2000 read with rule 3(1)(d) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2025 for the takedown of applications and URLs.
06.3
Entities
Fifteen offshore VDA service providers.
Weex, Blofin, Rezorex, Bitunix, DigiFinex
Toobit, XT.com, Latoken, WOO X, Pionex
ChangeNow, SimpleSwap, Fixedfloat, WhiteBIT, Guardarian
06.4
Context
VDA service providers, whether offshore or onshore, were brought within the AML and CFT framework in March 2023 and must register with FIU-IND as reporting entities where they exchange VDAs against fiat, transfer VDAs, or hold or administer VDAs or the instruments controlling them.
06.5
Action
Clients holding assets on any of these fifteen platforms should retrieve statements and plan an orderly exit now, while the platform is still reachable. After a takedown, recovering trade history is difficult, and that history is still needed for Schedule VDA and for capital-gains computation.
Item 07 · FEMA circular rationalisation · FEMA · withdrawal
07.1
Reference
A.P. (DIR Series) Circular No. 21 [RBI/2026-27/254] dated 8 September 2026, "Review of Circulars issued under Foreign Exchange Management Act, 1999".
07.2
Basis
The RBI's continuing review of all circulars issued under FEMA since 1 June 2000, withdrawing those that have ceased to be operative through subsequent amendment, redundancy, overlap or supersession.
07.3
Withdrawn
Seven A.P. (DIR Series) circulars.
No. 17 of 29.09.2015 - ECB policy, rupee-denominated bonds overseas
No. 25 of 03.09.2014 - ECB in Indian Rupees
No. 85 of 06.01.2014 - ECB policy, liberalised infrastructure-sector definition
No. 81 of 24.12.2013 - borrowing and lending in rupees, investment by non-residents in tax-free secured redeemable NCDs
No. 119 of 26.06.2013 - ECB for import of services, technical know-how and licence fees
No. 49 of 07.11.2012 - Money Transfer Service Scheme, list of sub-agents
No. 48 of 06.11.2012 - ECB by SIDBI
07.4
Note
Withdrawal removes dead text. It does not revive any earlier position and creates no new obligation.
07.5
Action
Re-point any standing FEMA or ECB opinion, sanction note or compliance manual that still cites the seven circulars, so the authority quoted is the instrument currently in force.
Item 08 · PSL Third Amendment Directions, 2026 · RBI · amendment
08.1
Reference
Reserve Bank of India (Priority Sector Lending - Targets and Classification) Third Amendment Directions, 2026, RBI/2026-27/256, FIDD.CO.PSD.BC.No.10/04.09.001/2026-27, dated 11 September 2026.
08.2
Background
The Second Amendment Directions of 7 August 2026 excluded from Adjusted Net Bank Credit any advance made in India against fresh deposits qualifying for CRR and SLR exemption, namely FCNR(B) deposits of minimum three and maximum five years, and NRE term deposits of three years or more, including renewals, mobilised from 8 June 2026 onwards.
08.3
What changed
The closing date of that mobilisation window is amended from 30 September 2026 to 31 August 2026. Item VI in the table at paragraph 6.1 of the PSL Directions, 2025 (updated to 7 August 2026) is modified accordingly, and the cross-reference now runs to the CRR and SLR Fourth Amendment Directions of 25 August 2026.
08.4
Limit
The amount excluded from ANBC cannot exceed the fresh outstanding FCNR(B) and NRE deposits eligible for the exemption.
08.5
Action
Banking clients should recompute priority-sector targets: deposits mobilised in September 2026 no longer earn the ANBC exclusion, so the PSL base is larger than the August working assumed. Relevant to any NRI deposit campaign priced on the earlier end date.
Item 09 · Handbook on NRI residential status · ICAI · publication
09.1
Reference
Handbook on Residential Status for NRIs - Tax and FEMA Aspects, International Taxation Committee, ICAI. Edition July 2026, 165 pages, ISBN 978-93-47892-90-5, published by the Publication and CDS Directorate; basic draft prepared by CA. Uday Ved. The Publication Portal carries no release date against it.
09.2
Why now
The Income-tax Act, 2025 restructured and renumbered residence provisions that had stood for more than sixty years. Members must work two statutes in parallel: the 1961 Act for earlier years and the 2025 Act for the years ahead.
09.3
The mapping
Table 2.1 traces each limb of s.6 from the old Act to the new.
s.6(2)(a) and 6(2)(b) - the 182-day and 60-day / 365-day tests, formerly s.6(1)(a) and s.6(1)(c)
s.6(3) - crew of an Indian ship, and the employment-departure carve-out, formerly Explanation 1(a) to s.6(1)
s.6(4) and 6(5) - the visiting Indian citizen and PIO carve-out and the Rs 15 lakh threshold, formerly Explanation 1(b) to s.6(1)
s.6(6) - day computation for crew of foreign-bound ships, formerly Explanation 2 to s.6(1)
s.6(7) and 6(8) - deemed residency, formerly s.6(1A)
s.6(13) - the not-ordinarily-resident conditions, formerly s.6(6)
09.4
Tax against FEMA
Residence under the income-tax law turns on physical presence; residence under FEMA turns on the intention and purpose of the stay. The two may, and often do, give different answers for the same person in the same year. Chapter 10 tabulates the four significant combinations that result, which is the part worth reading first.
09.5
Also covered
Treaty entitlement and foreign tax credit, global mobility and transfer pricing; judicial precedents including the DTAA tie-breaker analysis in Binny Bansal v. DCIT (Bangalore ITAT); the residency rules of six jurisdictions - the United States, UAE, Singapore, Canada, the Netherlands and Australia - each against the relevant DTAA; and worked case studies applying both regimes to the same facts. Scope is individuals only: entities, and NRI investment products and their consequences, are outside it.
09.6
Action
Use the Chapter 2 mapping table on returning-Indian, expatriate and seafarer files before quoting any residence section this season, since a 1961-Act citation in a 2025-Act year will now read as wrong. Note the companion Handbook on Safe Harbour Rules, covering safe harbour under the 2025 Act and the Income-tax Rules, 2026 and its interaction with APAs.
Item 10 · s.258 information sharing with Andhra Pradesh · Direct Tax · Record only
10.1
Reference
Two instruments of the same date, same file F.No. 225/84/2024/ITA-II.
Notification No. 118/2026 [S.O. 5003(E)] dated 9 September 2026
Order under s.258(1) dated 9 September 2026, the operative implementation order
10.2
Basis
s.258(1)(b) of the Income-tax Act, 2025, specifying the Secretary, ITE and C, Government of Andhra Pradesh as an authority to whom taxpayer information may be furnished.
10.3
Mechanism
The state supplies Aadhaar or PAN with the relevant tax year. The Department responds Yes, No or Not Available against a mutually agreed income threshold, rather than disclosing income figures. Where Aadhaar is not linked to a PAN, the reply records that information is unavailable for want of linkage.
10.4
Safeguards
The DGIT (Systems) and the state authority must agree frequency and mode of exchange and execute a memorandum of understanding covering secure transfer, confidentiality, preservation, deletion after use and timelines, with a copy to the relevant CBDT division.
10.5
Note
No client action. Noted because it shows the shape s.258 sharing is taking: a threshold flag rather than a data dump, and PAN-Aadhaar linkage as the gating condition.
Item 11 · LDC and NDC under the 2025 Act · Direct Tax · portal note
11.1
Reference
TRACES home-page notice, undated, read on 12 September 2026. Stated as the portal's current position rather than an instrument issued this week.
11.2
What changed
Lower and nil deduction certificates for Tax Year 2026-27 are being issued under the Income-tax Act, 2025, on Form 13 applications filed up to 31 March 2026.
11.3
Which applies
Where an old section corresponds to several sections under the new Act, the portal cites 194A and 194J(b) as examples, the certificate has been mapped to all relevant new-Act sections so that deductors are not left without cover.
11.4
Action
Before applying a lower rate, check that the new-Act section shown on the certificate matches the actual nature of the payment. The mapping is automatic and generous, so a certificate may list sections the payment does not attract, and may still miss one that it does.
Item 12 · Form 141 correction facility · Direct Tax · portal note

12.3
What is not
The correction facility for Schedule D (Kind) is not yet available; the portal states it will be enabled shortly.
12.4
Action
Hold any Schedule D (Kind) correction until the facility opens. Do not route the correction through another schedule to force it through, since that creates a second mismatch to unwind later.
